The Ryde Garden development comprises three residential towers of 13, 23 and 27-storeys. The project features 830 residential apartments with basement parking for 730 cars, 2100 m2 of a public park, rooftop gardens and a communal pool, 1100 m2 of non-residential floor space including retail space, gym and an area dedicated for a future child care centre. SJA was commissioned by Country Garden Australia, trading as BGY North Ryde.
BGY had entered into off the plan contracts with purchasers and each of the contracts contained a provision to extend the sunset date for the completion of the project by each day that the progress of the building works was affected by:
(i) delays by authorities in giving approvals or
(ii) delays beyond BGY’s reasonable control
SJA was commissioned as the Independent Certifier (IC) to discharge IC duties and services under the sales contracts and asses, whether the progress of the building works was affected by the factors, described and determine the number of days the building works were delayed and the new sunset date for insertion into the sales contracts.
